PerkFuel is a platform that helps website owners and businesses generate website traffic associated with AI referral sources, based on campaign settings you configure, including target pages, AI sources, countries and delivery pace.

Visits are tracked in your PerkFuel dashboard and, where properly configured, may also appear in third-party analytics tools such as Google Analytics.

You remain responsible for the websites, pages and campaign settings you submit to the Service.

PerkFuel is available to businesses, professionals and individual website owners.

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and legally capable of entering into a binding agreement.

You must own, manage or have the necessary authorization to submit and use any website or landing page added to PerkFuel.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate account information and keep it reasonably up to date.

PerkFuel operates using visit credits.

One visit credit represents one visit recorded as completed by PerkFuel to a landing page configured within your project.

A visit credit is deducted when the Service records the corresponding visit as completed.

Your PerkFuel dashboard displays your available visit balance, used visits and campaign activity.

Third-party analytics platforms may report different numbers from your PerkFuel dashboard due to differences in tracking methods, attribution, consent settings, browser restrictions, ad blockers, analytics configuration or other factors outside PerkFuel's control.

For the purpose of calculating your PerkFuel visit credit balance, the activity recorded by the Service will be used, except in the case of an identified technical or reporting error.

Visit credits are not a currency, cannot be transferred between users and have no cash value except where a refund is expressly available under Section 8.

PerkFuel offers paid subscription plans billed monthly through Stripe.

Each plan includes a monthly allowance of visit credits and a maximum number of active projects, as described on our Pricing page or at the time of purchase.

Subscriptions automatically renew each month until cancelled.

Your payment method will automatically be charged at the beginning of each new billing cycle at the applicable subscription price unless you cancel before your next renewal date.

Unused monthly visit credits do not carry over between billing cycles. Your monthly allowance resets at the beginning of each new billing cycle.

You may cancel your subscription at any time from your account.

Where required by applicable law, we will provide appropriate notice of material changes to subscription pricing or billing terms.

New users may receive a limited number of free visit credits to test the Service, as described on our website or within the application.

No payment card is required to begin the standard free trial unless otherwise clearly stated before activation.

Free trial visits may be provided over a shorter timeframe than visits under a paid subscription so that users can evaluate the Service sooner.

Free trials are intended for genuine evaluation of PerkFuel and are generally limited to one free trial per person, account, business or website unless otherwise authorized by PerkFuel.

Creating multiple accounts, using false information or otherwise attempting to circumvent free trial limitations is prohibited.

We may restrict, suspend or revoke free trial access where we reasonably detect duplicate accounts, abuse or attempts to circumvent trial limitations.

Free trial visit credits have no cash value and are not refundable.

We may modify or discontinue free trial offers at any time.

You may upgrade or downgrade your subscription plan from your account.

Plan upgrades take effect immediately. The applicable prorated price difference may be charged at the time of the upgrade, and the upgraded plan benefits become available immediately.

Plan downgrades take effect at the beginning of your next billing cycle. Until then, you retain access to your existing plan and remaining visit balance for the current paid period.

Any pricing and allowance information displayed when confirming a plan change forms part of that transaction.

Additional visit credits may be available for purchase separately as a top-up without requiring a change to your subscription plan.

The quantity, price and any specific conditions applicable to a top-up will be displayed before purchase.

Promotional, complimentary or bonus visits may occasionally be added to an account by PerkFuel.

Bonus, promotional and complimentary visit credits have no cash value, cannot be exchanged for money and are not refundable.

They may be subject to specific usage or expiration conditions communicated when they are granted.

Unless otherwise stated, receiving bonus or promotional visit credits does not modify the price, renewal date or other conditions of your subscription.

Except where required by applicable law, payments for PerkFuel subscriptions, plan upgrades and visit credit top-ups may be eligible for a refund only if:

1. the refund request is submitted within seventy-two (72) hours of the relevant payment; and
2. no paid visit credits associated with the relevant purchase or billing cycle have been used.

Once any paid visit credit associated with the relevant purchase has been used, that payment is no longer eligible for a refund under PerkFuel's voluntary refund policy.

Partial refunds for remaining unused visit credits are not provided under this voluntary refund policy once usage has begun.

Free trial visits, bonus visits, promotional visits and other visit credits provided without charge have no cash value and are not refundable.

Cancelling a subscription prevents future renewals but does not automatically constitute a refund request or create an entitlement to a refund.

Refund requests must be submitted to contact@perkfuel.io.

Approved refunds will normally be returned to the original payment method.

Immediate performance and right of withdrawal

PerkFuel is a digital service that begins as soon as your account is created and a project is started. By creating an account and accepting these Terms, you expressly request that the service starts immediately, before the end of any statutory withdrawal period.

If you are a consumer with a statutory 14-day right of withdrawal, you acknowledge and agree that by using the service, including starting a project or consuming any paid visit credit, the service has started at your express request and you waive your 14-day withdrawal right for the relevant purchase.

Where the service has not yet been used, the voluntary refund conditions above apply, and any withdrawal right that cannot be waived under applicable law remains unaffected.

Nothing in this Section limits any mandatory consumer rights or statutory refund, cancellation or withdrawal rights that cannot be waived under applicable law.

If applicable law grants you rights that are more favorable than this voluntary refund policy, those rights will apply.

If you believe a payment was made incorrectly, we encourage you to contact us at contact@perkfuel.io before initiating a chargeback or payment dispute so that we can attempt to resolve the issue.

Fraudulent, abusive or repeated unjustified chargebacks may result in suspension or termination of your account.

Nothing in this Section prevents you from exercising any right to dispute an unauthorized or incorrect charge available under applicable law or through your payment provider.

You are responsible for ensuring that you own or have the necessary rights to use the websites and pages you submit to PerkFuel.

You must use the Service in compliance with applicable laws and must not use PerkFuel for unlawful, deceptive, fraudulent or abusive purposes.

You represent and warrant that no website, page or content submitted to or promoted through the Service is illegal, unlawful or infringes the rights of any third party.

Without limiting the foregoing, the Service must never be used to promote or drive traffic to content involving:

• counterfeit or illegal goods;
• unlicensed pharmaceuticals or controlled substances;
• malware, phishing or credential theft;
• fraud or financial scams;
• child sexual abuse material;
• content that unlawfully infringes intellectual property rights;
• any other content or activity prohibited by applicable law.

You must not use PerkFuel to generate fraudulent advertising activity, manipulate advertising clicks or impressions, abuse affiliate or referral programs, or engage in any activity intended to fraudulently obtain compensation or deceive third parties.

Any campaign, page or website found to violate these requirements may be paused or removed immediately.

Depending on the nature and severity of the violation, we may suspend or permanently terminate the associated account.

Where appropriate or legally required, PerkFuel may report unlawful activity to relevant authorities.

PerkFuel provides website visits according to your campaign settings and the features available under your plan.

Results depend on numerous factors outside PerkFuel's control, including your website, offer, content, landing pages, pricing, audience and overall user experience.

Past activity or results should not be interpreted as a guarantee of future performance.

Campaign pacing may be configured according to the options available under your plan.

Delivery schedules, pacing indicators, estimated completion times and similar information displayed by PerkFuel are estimates and may vary.

Actual timing may be affected by campaign settings, selected sources, selected countries, technical conditions, availability and other operational factors.

Visits do not necessarily occur at perfectly equal intervals.

PerkFuel may temporarily pause, delay or adjust campaign activity where reasonably necessary for technical, operational, security or compliance reasons.

The Service is provided on an "as is" and "as available" basis.

We aim to keep PerkFuel available and operational but do not guarantee uninterrupted, continuous or error-free availability.

Scheduled maintenance, technical issues, infrastructure problems, security events or circumstances outside our reasonable control may temporarily affect access to the Service or campaign activity.

We may modify, update, replace or discontinue individual features of the Service where reasonably necessary.

PerkFuel may reference or interact with third-party services, AI assistants, analytics platforms and other external technologies.

PerkFuel is an independent service and is not affiliated with, endorsed by, sponsored by or operated by the third-party AI platforms referenced within the Service unless expressly stated otherwise.

Third-party names, trademarks, logos and brands remain the property of their respective owners.

Third-party services may modify their technology, features, availability, tracking methods or policies at any time.

PerkFuel is not responsible for changes, outages, restrictions, reporting differences or other actions made by third-party services.

The appearance, attribution or measurement of traffic within third-party analytics tools may depend on the user's own analytics configuration and the technical behavior of those third-party platforms.

The PerkFuel name, logo, website, application, interface, software, content and branding are protected by applicable intellectual property laws.

These Terms do not grant you ownership of or rights to PerkFuel's trademarks, software, branding or other intellectual property except for the limited right to use the Service in accordance with these Terms.

You may not copy, reproduce, modify, distribute, reverse engineer or commercially exploit protected elements of the Service except where expressly authorized by PerkFuel or permitted by applicable law.

If you believe that material accessible through the Service infringes your copyright, you may send a written notice to contact@perkfuel.io.

Your notice should include:

• identification of the copyrighted work claimed to be infringed;
• identification and location of the material claimed to be infringing;
• your contact information;
• a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law;
• a statement that the information provided in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

We may remove or disable access to material in response to a valid copyright complaint.

We may suspend, restrict or terminate your account if:

• you violate these Terms;
• you engage in fraudulent, unlawful or abusive behavior;
• you attempt to circumvent Service or free trial limitations;
• your use creates a security or operational risk;
• we are required to do so by law;
• continued provision of the Service would expose PerkFuel or third parties to material legal or security risk.

Where reasonable, we may provide notice before taking action. Serious violations may result in immediate suspension or termination.

Termination resulting from a violation of these Terms does not create a right to a refund except where required by applicable law.

You may cancel your subscription at any time through your account.

Cancellation prevents your subscription from renewing at the end of the current billing cycle.

Unless otherwise stated, cancellation does not immediately remove access to your current paid plan. You may continue using your existing plan and remaining available visit credits until the end of the billing period you have already paid for.

At the end of that billing cycle, your paid subscription will terminate unless you reactivate or purchase another plan.

Following cancellation or account termination, we may retain or delete account, billing, project and campaign information in accordance with our Privacy Policy and applicable law.

To the maximum extent permitted by applicable law, PerkFuel's total liability arising out of or relating to these Terms or the Service will not exceed the amount you paid to PerkFuel during the three (3) months immediately preceding the event giving rise to the claim.

To the maximum extent permitted by applicable law, PerkFuel will not be liable for indirect, incidental, special, exemplary or consequential damages, including loss of profits, revenue, business opportunities or data.

Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.

Except as expressly stated in these Terms and to the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express, implied or statutory.

This includes implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in this Section affects warranties or rights that cannot legally be excluded under applicable consumer protection law.

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless PerkFuel, its owners, employees and contractors from claims, liabilities, damages, losses and reasonable legal expenses arising out of or connected with:

• your unlawful or unauthorized use of the Service;
• websites, pages or content you submit or promote through the Service;
• your material violation of these Terms;
• your violation of applicable law;
• your infringement of intellectual property, privacy, publicity or other third-party rights.

This Section does not apply to the extent that a claim results from PerkFuel's own unlawful conduct or where such an obligation cannot legally be imposed on you.

PerkFuel will not be liable for failure or delay in performance caused by circumstances beyond its reasonable control.

These circumstances may include internet or infrastructure outages, failures of third-party infrastructure or service providers, cybersecurity incidents, natural disasters, government actions, labor disruptions, power outages, changes to third-party platforms or APIs, and other events outside PerkFuel's reasonable control.

By creating an account, you agree to receive communications necessary to provide and operate the Service.

These may include account notifications, verification messages, billing information, payment confirmations, subscription notices, campaign notifications, security alerts and support communications.

Where permitted, we may also send marketing or promotional communications.

You may unsubscribe from marketing communications at any time. Unsubscribing from marketing communications does not prevent us from sending messages that are necessary to operate or administer your account.

We may update these Terms from time to time.

When changes are made, the "Last updated" date at the top of this page will be updated.

Where required by applicable law, or where a change materially affects your rights or obligations, we may provide additional notice.

Your continued use of the Service after updated Terms become effective constitutes acceptance of those updated Terms, except where applicable law requires another form of consent.

Before initiating formal proceedings, you agree to contact us at contact@perkfuel.io and allow us a reasonable opportunity to attempt to resolve the dispute informally.

If a dispute cannot be resolved informally within thirty (30) days, then, except where prohibited by applicable law, the dispute shall be resolved through binding, individual arbitration rather than through a court proceeding.

Except where prohibited by applicable law, disputes must be brought individually and not as part of a class action, class arbitration or representative proceeding.

Either party may bring an eligible individual claim in small claims court.

Nothing in this Section removes any right that a consumer has under mandatory applicable law to bring a claim before a competent court, regulator or consumer dispute resolution body where that right cannot legally be waived.

These Terms are governed by the laws of England and Wales, without regard to its conflict of law provisions.

However, if you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country or jurisdiction and that cannot legally be waived.

Subject to Section 25 and to the extent permitted by applicable law, legal proceedings not subject to arbitration shall be brought in the courts of England and Wales.

Nothing in this Section limits a consumer's right to bring proceedings in another jurisdiction where mandatory applicable law provides such a right.

These Terms constitute the entire agreement between you and PerkFuel regarding the Service and supersede prior agreements concerning the same subject matter.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

You may not assign or transfer these Terms without our prior written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets or similar transaction.

Headings are provided for convenience and do not affect the interpretation of these Terms.
